1. Introduction

Welcome to Riskfend Hub. These Terms of Service ("Terms") govern your access to and use of the Riskfend Hub website, platform, and services (collectively, the "Services") provided by Riskfend Ltd ("we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Description of Service

Riskfend Hub provides a missed-call recovery and automated SMS text-back platform designed to help businesses capture and respond to missed inbound phone calls.

We provide you with a dedicated routing telephone number (provisioned via Twilio Inc.) and an online dashboard to manage communications, leads, and automated responses.

3. Account Registration & Security

To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

You are responsible for safeguarding the credentials you use to access the Services. You agree not to disclose your login credentials (such as your email magic-link access) to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use & Anti-Spam Policy

Our platform is designed strictly for transactional communications and recovering inbound missed calls.

You agree NOT to use the Services to:

• Send unsolicited marketing campaigns, promotional broadcasts, or "spam" SMS messages.
• Send messages to individuals who have not explicitly contacted your business or consented to receive communications.
• Transmit any material that is unlawful, harassing, defamatory, abusive, threatening, harmful, or obscene.
• Violate any applicable laws, including but not limited to the Privacy and Electronic Communications Regulations (PECR), the UK GDPR, or the telecommunications regulations of any country where you operate.

We reserve the right to immediately suspend or terminate your account without notice or refund if we determine, in our sole discretion, that you have violated our Acceptable Use & Anti-Spam Policy.

5. Phone Numbers & Carrier Routing

When you subscribe, we allocate a UK telephone number to your account to route calls and texts. This number is leased to you for the duration of your active subscription but remains the property of Riskfend Ltd and our telecommunications providers.

Upon account closure, cancellation, or failure to pay subscription fees, the phone number will be immediately reclaimed and may be reassigned to other parties after a standard cooling-off period. We are not liable for any loss of business, printed marketing materials, or damages resulting from the reclamation of a phone number.

You are solely responsible for configuring your primary business mobile or landline to correctly divert missed calls to your Riskfend routing number. We are not liable if your telecommunications carrier fails to divert calls correctly.

6. Fees, Billing, and Cancellation

Access to Riskfend Hub is provided on a subscription basis. By subscribing, you agree to pay all applicable fees at the prices in effect when the charges are incurred.

Billing Cycle

Subscription fees are billed automatically on a recurring monthly basis via our payment processor, Stripe.

Cancellation

You may cancel your subscription at any time through your dashboard settings. Upon cancellation, you will retain access to the Services until the end of your current paid billing cycle. No pro-rated refunds are provided for partial months.

7. Intellectual Property

The Riskfend Hub platform, including its original content, features, functionality, software code, and design, are and will remain the exclusive property of Riskfend Ltd and its licensors. The Services are protected by copyright, trademark, and other laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business operations during your active subscription period.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Riskfend Ltd, its directors, employees, partners, or suppliers, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services;
• Any failure of external telecommunications networks, carrier blocks, SMS filtering, or routing latency;
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims arising out of or relating to the use of the Services exceed the total amount paid by you to us during the three (3) months immediately preceding the event giving rise to the liability.

9. Disclaimer of Warranties

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

10. Indemnification

You agree to defend, indemnify, and hold harmless Riskfend Ltd, its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Services;
• A breach of these Terms, specifically including any violations of our Anti-Spam Policy or applicable telecommunications laws (e.g., PECR, TCPA);
• Any third-party claims brought against us due to your unauthorized SMS marketing or messaging activities.

11. Data Retention & Deletion

Upon cancellation of your subscription or termination of your account, Riskfend Ltd reserves the right to permanently delete all your data, including call logs, SMS history, and customer lists, in accordance with our data minimization obligations under the UK GDPR. We are not responsible for any loss of data resulting from the termination of your account.

12. Force Majeure

Riskfend Ltd shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including "line-noise" interference, carrier outages, or Twilio API downtime).

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes via email or through the platform dashboard.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
